States refusing federal health care could see downside | NOLA.com

For Gov. Rick Perry, saying "no" to the federal health care law could also mean turning away up to 1.3 million Texans, nearly half the uninsured people who could be newly eligible for coverage in his state. Gov. Chris Christie not only would be saying "no" to President Barack Obama, but to as many as 245,000 uninsured New Jersey residents as well.

The Supreme Court's recent ruling gave governors new flexibility to reject what some Republicans deride as "Obamacare." But there's a downside, too.

States that reject the law's Medicaid expansion risk leaving behind many of their low-income uninsured residents in a coverage gap already being called the new "doughnut hole" ? a reference to a Medicare gap faced by seniors.

Medicaid is a giant federal-state health insurance program for the poor, now mostly covering children, mothers and disabled people. The expansion in Obama's health care overhaul was originally expected to add roughly 15 million uninsured low-income people, mainly adults without children, who currently are not eligible in most states. Washington would pick up the entire cost for the first three years, with the federal share then dropping to 90 percent. The Medicaid expansion accounts for about half the total number of uninsured people projected to get coverage under the law.

If every state were to reject that Medicaid expansion ? as the Supreme Court ruling now allows ? some low-income people would still be picked up by other coverage provisions meant to help the middle class.

But nearly 11.5 million uninsured people below the federal poverty line would be left behind in a new coverage gap, according to recent estimates from the Urban Institute. That brings to mind the infamous "doughnut hole" in the Medicare prescription drug benefit, in which seniors with high drug costs find themselves paying out of pocket much of the year.

Those who fall into the new gap would neither qualify for Medicaid in their states under current rules nor be eligible for subsidized private insurance in new state marketplaces that Obama's law calls exchanges.

Low-income children and mothers would continue to have insurance through Medicaid. Then, starting in 2014, millions of people over the poverty line would have subsidized private coverage through the new exchanges. "And then this group in the middle has nothing," said Matt Salo, executive director of the National Association of Medicaid Directors. His organization takes no position on what states should do.

Things only get trickier from there.

Many states might actually go along with the Medicaid expansion.

"This is a lot of federal dollars that will lead to a lot of people having health care," said Salo. That means federal taxes from states opting out would be helping to subsidize coverage elsewhere.

And hospitals in opt-out states would still get hit with cuts programmed in the law under the assumption that every state would take the Medicaid expansion and fewer uninsured people would be needing charity care.

"You are still paying for that coverage expansion but not getting the benefit of it," said Herb Kuhn, president of the Missouri Hospital Association. "So you as a state are exporting your dollars to another state. If you have some adjoining state that accepts (the Medicaid expansion) then you are basically sending your dollars to your neighbor."

Kuhn's state is leaning against the expansion. Since the Supreme Court ruling last month, Republican leaders in at least 10 states have indicated they will reject or lean toward rejecting the Medicaid expansion. They cite a combination of reasons, including strained budgets, lack of confidence that Washington will honor its financial commitments in the long run and years of frustration with Medicaid mandates that limit state choices and shift costs from the federal government.

But other state officials are saying they will study their options and wait until after the November elections to decide. If Republican Mitt Romney wins the White House and starts dismantling Obama's law, opt-out states might not have to face the Medicaid doughnut hole. But the whole calculation changes if Obama is re-elected and his overhaul starts looking more and more like a done deal.

If that happens, some experts expect that states now refusing will try to cut deals with the federal government, angling for concessions on the expansion itself or the rest of their Medicaid programs.

"One of the things that happens in cases like these is negotiated settlements with specific states," said Dan Mendelson, president of Avalere Health, an analytical firm serving health care industry and government clients. "What I expect to happen here is that the federal government is going to be more flexible and allow states to do the expansion in ways that suit them."

It's hard to see that happening now. Opponents of the health care law are as adamant as ever, even after the Supreme Court upheld most of it, including the mandate that most Americans carry health insurance or pay a fine.

"I will not be party to socializing health care and bankrupting my state in direct contradiction to our Constitution and our founding principles of limited government," Texas Gov. Perry said last week. About one-fourth of Texas residents are uninsured, the highest percentage of any state.

But John Hawkins, top lobbyist for the Texas Hospital Association, says his group isn't dropping the subject.

"We have told the governor we are willing to continue the discussion," said Hawkins. "It's hard to imagine how you get from here to there without accessing federal funds at some level."

New York trans fat ban has cut consumption, study finds

New York City's pioneering ban on all but the smallest amounts of trans fats in restaurant food has led to a significant reduction in consumption, a change that should translate into better cardiovascular health in the nation's largest city, according to a new report. It also demonstrates that coffee shops, fast-food joints and other eateries can play a major role in improving the health of the public, the study authors said.

Officials from the New York City Department of Health and Mental Hygiene conducted the study to assess whether the regulation that took effect in 2008 ? which prohibits all restaurants from serving food prepared with partially hydrogenated vegetable oil or dishes that contain more than 0.5 gram of trans fat per serving ? was making a difference for diners.

Public health officials had zeroed in on trans fats because they pose a uniquely potent health risk. Adding fewer than 4.5 grams of them to a 2,000-calorie daily diet can increase the risk of coronary heart disease by 23%, studies have found.

Researchers fanned out across Manhattan in 2007 and examined the receipts of 6,969 diners as they left fast-food restaurants at lunchtime. (The researchers went to fast-food chains because the nutrition information on the items sold there was readily available.) In 2009, they repeated the exercise with 7,885 receipts. They found that diners consumed 2.4 fewer grams of trans fat per lunch after the ban went into effect, according to their study published in Tuesday's edition of Annals of Internal Medicine.

That decline was offset by only a slight 0.55-gram increase in consumption of saturated fats, which are also associated with elevated cholesterol levels.

"Given that one-third of calories in the United States comes from food prepared away from home, this suggests a remarkable achievement in potential cardiovascular risk reduction through food policy," the authors reported.

Alice Lichtenstein, director of the Cardiovascular Nutrition Laboratory at Tufts University in Boston, said the findings showed "that public health initiatives, if done right, seem to work." A key factor, she said, was that diners didn't have to choose: "The environment has been shifted so that you automatically will get the healthier option."

New York MayorMichael R. Bloomberghas taken an active role in efforts to improve public health. In addition to leading the fight against trans fats, he has required chain restaurants to post calorie information on their menu boards and called for a ban on super-sized sugary drinks.

Trans fats are found naturally in meat and dairy products, but the biggest source in the American diet is processed oils, commonly partially hydrogenated vegetable oils. Favored for their shelf-stable qualities, such oils were widely used in baked and fried foods.

The researchers found that the proportion of meals purchased that contained zero grams of trans fat rose from 32% before the ban went into place to 59% afterward. And they found that the benefits were shared equally by diners in working-class neighborhoods and patrons in tonier sections of the city.

Other cities and states followed New York City's lead, including California in 2008. The federal government also required manufacturers to list the amount of trans fats contained in processed foods, beginning in 2003.

The food industry has responded by reformulating its products.

Nationwide, the average daily consumption of trans fats has gone from 4.6 grams in the 1990s to 1.3 grams in 2010, said Kelley Scanlon, an epidemiologist with the Centers for Disease Control and Prevention. "Things are clearly much better."

However, in a report this month in the Journal of theAmerican Medical Assn., Scanlon and a CDC colleague noted that trans fats are still found in many processed foods, including up to 7 grams a serving in some microwave popcorns. More needs to be done, she said.

The changes made by restaurants were costly but necessary, said Joy Dubost, director of nutrition and healthy living at the National Restaurant Assn.

"The science is very convincing with regard to consumption of trans fats, so the industry had been working on this," she said.

The association would not say how much it had cost restaurants to switch from trans fats to more healthful fats because the information was proprietary. Several individual restaurant chains declined to discuss costs as well.

Whatever the expense, frequent food industry critic Kelly Brownell said the study suggested the public should be skeptical when big companies resist change.

"They said it would narrow the range of consumer products; that didn't happen," said Brownell, director of the Rudd Center for Food Policy and Obesity at Yale University. "They said it would affect the taste, and that didn't happen. They said there would be no benefit, and that didn't happen."

The SR20000G has five Gigabit Ethernet ports, so you can also use it as a bridge to connect wired devices such as consoles, multimedia players and other devices, to your network.

Equipped with dual 600mW amplifiers for each radio band, the SR20000G also ships with two external 5dBi high gain antennas. The repeaters support up to 300 Mbps on both bands. Inside, is a 620 MHz processor. The device is compatible with Wi-Fi networks secured with WEP, WPA, WPA2, or WPS since it supports all of those standards. There's also a single USB 2.0 port for sharing data on USB storage drives.

Setup
You'll want to place the repeater mid-way between where you can get a strong signal from your router and a dead zone. You don't have to pick the perfect spot to start with: You can set up the repeater close to the router initially, and then move it to the desired locations, without losing any configuration settings. Most repeaters work best in line-of-sight with the routers. However, I had two walls in between the router and the SR20000G, and still got a strong repeated signal.

As soon as the repeater is fired up you can see two new SSIDs: Amped_Rep_2.4 GHz and Amped_Rep_5.0 GHz. Connect to either of those SSIDs and you can access the repeater's management interface. The interface opens to the Smart Setup Wizard, which walks through setting up the repeater.? First you scan for the network you want to repeat/extend. Select the network from the results, one for 2.4 GHz and one for 5 GHz.? You can only choose networks that are transmitting at minimum 70 percent signal strength. The wizard lists the signal strength of all wireless networks in proximity as well as their encryption level and the channel each network uses.

If the network you want to extend is encrypted, you have to enter the security key in the next step to setup the repeater. You can leave the default name of the extended network (the SSID with _Rep_5.0 Ghz 0r Rep_2.4 Ghz added,) or you can create your own names/SSID for the extended network.?

Besides a lengthy reboot (which takes 160 seconds), there isn't more to set up. Afterwards you can disconnect the repeater and move it to where you want to operate it without fear of losing your settings.

Features
There are also extra features within the interface for further configuration.? You can set up USB storage, guest networking, and even user access control all through the repeater. Devices can be allowed or denied access to the repeater by entering that device's MAC address. I also like the fact you can tweak wireless settings, such as changing the channel or channel width of the 5 GHz band independent from the router's settings?or you can just copy the settings from the router (which is probably best practice).? You can also get very granular with configuration by enabling features like TX beamforming and WAN portioning, among others.

What is Life? Venter Explains

On the evening of July 12, Ireland's Enda Kenny, the Prime Minister ? or Taioseach, in the proper Gaelic ? was running late, delayed a few minutes by affairs of state. The 400-strong audience, squeezed onto rows of doll-size chairs in the Examination Hall of Trinity College, Dublin, waited placidly. What, after all, did a few minutes matter, when the scientific world had waited almost 70 years for an event of this magnitude?

In 1943, the Austrian-born physicist Erwin Schr?dinger delivered a lecture at Trinity applying the principles of his own field to the foreign territory of biology. His purpose was to tackle the biggest question of all: what is life? He told his audience of 400, among them the then-Taoiseach Eamon de Valera, that the filaments in cells called chromosomes must contain "some kind of code-script" determining "the entire pattern of the individual's future development." This hypothesis would inspire the scientists James D. Watson and Francis Crick to seek that code-script. A mere decade later, they published a revolutionary article describing the double helix structure of what we now familiarly call DNA, explaining how it stores hereditary information. Their discovery underpins all modern genetics.

The idea of restaging Schr?dinger's momentous lecture for a 21st century audience arose after Dublin won the right to host the 2012 Euroscience Open Forum, a privilege Ireland's Chief Scientific Advisor Prof. Patrick Cunningham compares to securing the Olympics for the Irish capital. TIME reported on the original lecture in its April 5, 1943 issue. "Only in the precarious peace of Eire could Europe today provide such a spectacle," our un-bylined reporter wrote. "At Dublin's Trinity College last month crowds were turned away from a jampacked scientific lecture. Cabinet ministers, diplomats, scholars and socialites loudly applauded a slight, Vienna-born professor of physics."

The time and the place of Schr?dinger's talk ? not to mention the international coverage it received ? is important to Dubliners even today. "One of the things that's quite remarkable for us," says Cunningham, "is that in middle of the war, on the fringes of Europe, a magazine operating in the U.S. thought that this was something of sufficient consequence to write about it."

But how to find a modern scientist willing to tackle again a theme of such blinding magnitude? Who'd be prepared to endure comparison with the legendary Schr?dinger ? and not worry about the hubris of doing so? Which egghead possessed the intellectual capacity to give such a lecture and the communication skills to make its content accessible to the public?

Step up to the podium J. Craig Venter, the American geneticist who sparked the race to map the human genome and, despite a White House-brokered deal in 2000 to declare his small, private team and the government-funded Human Genome Project joint winners, is widely acknowledged to have edged out his competition. Ten years later, Venter announced an achievement that by his own estimation makes mapping the human genome "pale by comparison." He created synthetic life in a laboratory, by building the genome of a bacterium and inserting it into an existing host cell that had been stripped of its original DNA.

He told this tale during his own What Is Life? lecture, recounting how he watermarked the genome in order to demonstrate that the colony of bright blue bacteria multiplying in Petri dishes was indeed following the genetic instructions Venter had written. It would be hard to argue otherwise given that each new cell carried identifying codes that included Venter's name and a series of three quotes ? one from Dublin's famous son, James Joyce: "To live, to err, to fall, to triumph, to recreate life out of life." The Joyce estate, learning of this unusual use of the author's work, protested that Venter had not asked permission.

Venter has often elicited hostile responses, not least from within the scientific community. Watson, who shared the 1962 Nobel prize for his groundbreaking work on DNA, attacked Venter's first successes at using an automated process to sequence genomes quickly. The sequencing machines, he sniffed, "could be run by monkeys." The distinguished science journalist John Horgan, writing on Scientific American's Cross-check blog, described Venter as "the Lady Gaga of science. Like her, he is a drama queen, an over-the-top performance artist with a genius for self-promotion," and dismissed Venter's synthetic bacteria as "just another incremental step in the human manipulation of life." A profile in Forbes by Matthew Herper, dubbed Venter "the Bono of genetics," sniping that "he warps the reality field around genetic research through sheer force of ego and showmanship."

And yet Venter endures. Say what you will about his synthetic bacterium, no one else has achieved such a feat. And he is pressing on with other projects, more recently engineering a type of algae that is yellow rather than dark green, enabling light to pass through it so it can grow in greater density ? providing what he hopes will be an ideal raw material for biofuel.

A few hours before his lecture, the Bono of genetics sat down with TIME in Dublin's Clarence Hotel, which is co-owned by the Bono of U2. Stocky like the Irish musician and with a rock star's predilection for fast motors and private yachts, Venter in some respects lives up to his flamboyant reputation. But just as with the cell structures that are his obsession, the more closely you study him, the more evident his complexities become.

A perennial outsider ? "a rebellious attitude has probably been the most beneficial, although painful at times, trait in my life," he confesses ? he never worked comfortably within the scientific establishment. That, however, can sometimes be a good thing. He came away from a stint at the U.S. National Institutes of Health with some hard insights into the failings of taxpayer-funded institutions and projects. "Given the science budget that exists, we should all be upset that far more hasn't been achieved," he remarks. He also takes a swipe at the U.S. education system, which he says focuses too heavily on good grades (he was a C-student) and so "weeds out a lot of the creativity in the human population."

There are occasional swipes at his critics too. ("I'd rather continue what I'm doing and being able to do high-end science, than if I'd gotten a Nobel Prize 50 years ago and basically retired," he says, answering a question about whether he harbors ambitions to win the prize that has eluded him ? but was awarded to Watson precisely 50 years back.) Nonetheless, the quality that is most striking about Venter is his belief in the power of science to transform the world for the better, not least by solving the resource shortages that science, by allowing greater numbers of humans to live longer, helped to create in the first place.

"Optimists are the ones that get things done," he says. "Because, in science, if you're not optimistic about the outcome then you'll never do the experiment. Pessimists talk themselves out of doing the experiment, and therefore don't make any progress."

Progress is Venter's grail and he's impatient with the people and "prejudices" that slow progress, such as the once-widespread assumption that protein was what carried the code in genetic material. Venter himself is driven by another kind of code-script. Again like Bono, he's a latter-day missionary, with elements of self aggrandizement, yes, but also creative impulses and curiosity and even, say it softly, humanitarianism. He may enjoy his fame-cum-notoriety, but he also sees it as a way to get his message across. And he isn't interested in a closed conversation with other scientists. "The obligation to explain science to the public [is] an absolute, essential part of being a scientist," he says.

And so Venter accepted the challenge to follow in Schr?dinger's footsteps, knowing the lecture at Trinity would be live-streamed and blogged and reported more widely than any ordinary academic talk. He shared with this massively expanded audience his overview of the breakthroughs that, since Schr?dinger bestrode the same podium, he believes to be transformational. There is the concept of "digitizing biology" for one, uploading the details of genetic codes and sending them via computers, making possible, for example, the rapid manufacture of vaccines at the point of outbreak of an epidemic. There is the effort to synthesize every part of a cell, something that Venter and multiple other scientists are exploring. Venter also ventured to give a scientific answer to the question posed by the title of the lecture: "All living cells that we know of on this planet are DNA software ? driven biological machines comprised of hundreds of thousands of protein robots, coded for by the DNA, that carry out precise functions."

During the lecture, Venter's old adversary Watson, now 84 and in Dublin for the Euroscience Open Forum, sat in the audience, next to Taoiseach Kenny. After Venter concluded, Watson climbed slowly on to the stage, shook his hand and congratulated him on "a beautiful speech." Did he mean it? Did he not? Only he knows. Venter may be right that scientists will soon be able to create life, but we may be no closer to understanding it ? especially the human kind.

Sandy Blaine: When Worlds Collide: High-Tech Yoga

"What kind of crazy company," a friend emailed me, "pays for yoga classes for their employees and then insists on their right to get the least possible benefit from them?!"

And it does seem ludicrous, both what we've been hearing about Facebook's employee-coddling culture, and the image of a student reaching down from ardha chandrasana (half moon pose), a fairly challenging balance position, to punch in a text. This says so much about our current culture that I look forward to seeing it depicted on a New Yorker cover sometime soon.

Both the yoga community and my colleagues and students at Pixar, where I've been the company yoga teacher and provided wellness support for the past 17 years, have been abuzz with the story of a Facebook yoga instructor fired for insisting that this student turn off her cell phone during class. The consensus seems to be strongly on the side of the teacher, and I've heard much ridicule of Facebook's purported policy, not just from yogis, but from high tech industry friends as well. That email came from a web designer who is one of the most wired people I know, constantly texting during live conversations and never out of touch with his own Facebook page.

This issue hasn't actually come up for me; when a phone rings in my studio, the student who forgot to turn if off always scrambles, red-faced, to take care of it. And in my corporate classes, students don't even bring their phones; yoga is their break from being plugged in, and they don't want it disrupted by technology any more than I do. For the most part, I agree with my friend's assessment. As a yogi, it's disheartening to hear that yoga students would even have to be asked to turn off their phones. But there are two sides to every story.

Bringing yoga into the business world is a tricky mix, one that requires blending two completely different sets of needs, goals, and expectations. While a "no phones" policy is indeed a completely reasonable guideline for yoga classes, the fired teacher was not teaching in a dedicated yoga studio, and unless that rule is explicitly supported by the company she's working for -- and there were two companies in play here, Facebook and Plus One Health Management, the outside contractor that oversees FB's fitness classes and gym -- it's not her policy to set. She can request compliance but not demand it.

I started my career teaching yoga at UC Berkeley, where my classes were held in a basketball court. This was very early in the explosion of yoga into the mainstream, and I was sometimes astonished at what seemed to me extremely rude behavior. But I quickly realized that my expectations were born out of the yoga culture, and not necessarily shared by people coming to classes because their health club happened to offer them. I learned that teaching yoga etiquette -- for example, discouraging latecomers from tromping noisily through a room full of meditators -- was sometimes part of the job, especially when bringing yoga outside of its home environment.

Yoga teachers are only human; like anyone else, we have impatient moments, and times when something pushes our buttons that we handle less than skillfully. So if an incident like the one at Facebook happened in my class, I hope I'd have the presence of mind not to roll my eyes, but I can't swear that wouldn't be my first reaction. Still, glaring at a student with disdain seems out of bounds, no matter how absurd her behavior might seem. Another option would have been to respectfully ask the person to step outside to take care of whatever urgent business needed her attention, and return when she could focus. Imparting those lessons is far more effective when it's done with kindness. And a gentle, supportive approach is more in keeping with the spirit of yoga as well.

Ms. Van Ness is on record as saying that there's nothing "going on at Facebook that couldn't wait a half an hour," but that's a presumptuous statement, and not something she's in a position to decide. Even though I haven't had students use phones in my classes, people do often come in late or let me know they have to leave early for a meeting, and although it's not ideal to take a partial class, I've always felt it was better for them to get some practice time in than to miss it altogether. In my view, as with eating your vegetables, some yoga is better than none. And the job of teaching in a corporate setting is to support the employees' well-being in the context of their own culture.

Does that mean it's okay to text during yoga class? No, of course not. Not only is it detrimental to the student's own experience, it's distracting and rude to the other students as well. However badly this was handled on all sides, the bottom line is that multi-tasking is the opposite of yoga. The whole point is to train the mind to focus and be present through the physical practice. And that's where my high tech friend is absolutely on target. You only have to know a little bit about the physiology of stress, and the holistic effects of yoga, mindful breathing, and meditation to understand that the benefits of these practices are hugely reduced if they're not given full attention. Sort of like serving those vegetables deep fried.

That's something both Facebook and Plus One could benefit from considering: What are the goals for offering these classes, and how does a policy that "employees should be allowed to do whatever they want" affect the quality of what they're providing?

Facebook may not care if its employees achieve advanced yoga postures, much less reach enlightenment. And why should they? But presumably they do care about their employees' health, productivity, ability to focus, and how well they are able to deal, physically and mentally, with stress. In purely practical terms, a yoga class in which people are texting and chatting is going to be much less effective than one in which they are focused, quiet, and mindful. There is extensive scientific research on the mental and physiological benefits of these practices, and if the company's goals are to promote a healthy workforce and to send employees back to work refreshed and productive after class, it would be far more successful to treat the instructors as experts, rather than babysitters, and encourage respect for the basic tenets of the discipline being taught.

Documents conflict on when Romney left Bain

(AP) ? Federal documents filed by Mitt Romney's former company appear to conflict with the Republican presidential candidate's statements about when he left Bain Capital, the private-equity firm central to his legacy in the private sector.

In a filing with the Securities and Exchange Commission in February 2001, Bain Capital listed Romney as the company's "sole shareholder, sole director, chief executive officer and president." It said Romney's "principal occupation" was as Bain's managing director.

Romney's campaign repeatedly has said Romney had virtually nothing to do with the company's operations after February 1999, when he began work on the troubled 2002 Winter Olympic Games.

Romney "left Bain Capital in February of 1999 to run the Olympics, and had no input on investments or management of companies after that point," campaign spokeswoman Andrea Saul said Thursday.

Questions about Romney's control at Bain from 1999 to 2001 are important in his bid to oust President Barack Obama this fall. That's when the company oversaw investments that either sent jobs abroad or filed for bankruptcy. It's also a time during which Romney stated in federal disclosure forms that he was not active in Bain Capital.

For example, in late 1999, Bain-controlled Steam International set up overseas call centers, and a subsidiary moved jobs from California to Mexico. In 2000, the Ampad company declared bankruptcy. The following year, so did steel-maker GS Industries ? just as Bain made $58.4 million from its investment.

The two presidential campaigns differ about the extent to which U.S. jobs were affected. But the Romney camp's chief response long has been that Romney wasn't making decisions for the company when these events took place.

The campaigns exchanged sharp accusations Thursday about truthfulness and the issue of sending U.S. jobs to other countries.

Stephanie Cutter, Obama's deputy campaign manager, said Romney may have committed a felony if he misrepresented his role at Bain on the SEC documents. And if he was running Bain after 1999, Cutter said, Romney hasn't been truthful with the public.

"If that's the case, if he was lying to the American people, then that's a real character and trust issue," she said.

Romney's campaign, meanwhile, released a new TV ad titled "No Evidence." It accuses Obama of falsely depicting the former Massachusetts governor as someone who shipped jobs overseas when he ran Bain Capital. The ad, which will run in several battleground states, asks voters: "When a president doesn't tell the truth, how can we trust him to lead?"

The SEC document from February 2001 ? which has received modest attention despite being reported in recent days by publications including Talking Points Memo ? raises questions about Romney's role at Bain in 1999, 2000 and early 2001. If he turned his full attention to the Olympics in early 1999, as his campaign says, it's hard to square with the Bain SEC filing, two years later, listing his "principal occupation" as the company's managing director, and his titles as CEO and president.

Romney's campaign issued a statement Thursday from Bain that said Romney "left Bain Capital in February 1999 to run the Olympics and has had absolutely no involvement with the management or investment activities of the firm or with any of its portfolio companies since the day of his departure. Due to the sudden nature of Mr. Romney's departure, he remained the sole stockholder for a time while formal ownership was being documented and transferred to the group of partners who took over management of the firm in 1999. Accordingly, Mr. Romney was reported in various capacities on SEC filings during this period."

James Cox, a securities law professor at Duke University, said the SEC's "Schedule 13D" forms have always been under legal scrutiny by SEC officials and company executives. He said law firms hired to file such reports, known as "beneficial ownership reports" because they deem who can sell securities, "pay great attention to these forms. I don't find that these parts of the documents are casually reported."

"It's hard for me to believe you could be listed as 'management anything' without it taking up a bulk of your time," said Cox, who had not reviewed Bain's statement on Thursday.

Romney helped found Bain Capital in 1984. The private equity firm invested in various companies, often restructuring their management and operations. Some became success stories, hiring new workers and enriching Bain's investors. Others struggled or went out of business. Romney made millions of dollars, and he cites Bain as chief proof that he understands private enterprise and job-creation.

Romney eventually negotiated a retirement agreement with Bain Capital in 2002. The agreement was made retroactive to February 1999.

The Boston Globe reported Thursday that a Massachusetts financial disclosure form Romney filed in 2003 states that he still owned 100 percent of Bain Capital in 2002. Romney was elected to one term as Massachusetts governor in 2002.

(AP) ? A British judge will rule Tuesday on a bid by residents to stop their London tower block being used as a missile base during the Olympic Games.

Judge Charles Haddon-Cave had been due to give his judgment in the morning, but postponed the announcement until after lunch.

Residents of the 17-story Fred Wigg tower, about 2 miles (3 kilometers) from Olympic Park, say the missile battery could make their homes a terrorist target. They are seeking permission to bring a full court challenge to the deployment.

The British military says surface-to-air missiles also will be stationed at another apartment building, at a reservoir and farmland in east London, and along hillsides in south London as part of a vast security operation for the July 27-Aug. 12 games.

Living Well Foundation Helps Breast Cancer Patients and Their Families

A local cancer foundation provides both financial and social assistance to breast cancer patients with school aged children.

Joanna Francis is a single mom with 3 teenage boys and was diagnosed with breast cancer in 2005. She says ?I thought I was on that road to recovery and then in 3 years, I was re-diagnosed and I had several bone metastases and started popping up along the way." Through her journey to beat breast cancer, Joanna realized that people going through cancer treatment not only need medical support but could also use support from the community and with that in November 2011, the Living Well Foundation was born.

Francis states "there are needs that are unforeseen so this was able our idea is to get the people involved and share their services to patients and their families." Co-Founder of Living Well and also Nurse Educator at Tallahassee Community College, Jennifer Taylor, says their goal is to help the entire family and care group of the patient come together and feel like they are all supported. According to Taylor, ?the patient is receiving treatment but you also have the spouse, the sister, the mother who has to balance everything else, the mortgage, co-payments, still getting the kids to school, all of those services so making sure the whole group feels supported."

The Living Well Foundation assists in providing the social and financial assistance for non-medical expenses. Francis says the grants can ?go from anything from utilities to yard work, cell phone services, hotel if they need to travel for their appointments, some patients do choose to go out of town, gas cards, counseling for children if they need that, there is a wide variety." Taylor says "our goal is to help one patient every month, we've met that so far, and we?ve averaged that out."
