Jury hears tangled web of trader-turned-FBI-informant Khan

NEW YORK (Reuters) - She used the names of her housekeeper and her gardener to buy cell phones to evade detection. She lied to the FBI and to her "buddies" on Wall Street.

Former technology company researcher-turned-FBI-informant Roomy Khan went to great lengths to conceal a tangled web of insider trading. But she ended up pleading guilty and testifying against a California hedge fund manager to whom she says she fed corporate secrets.

Khan, 53, a onetime friend of hedge fund founder Raj Rajaratnam, is one of the more intriguing figures in the government's crackdown on Wall Street insider trading.

Testifying at the trial of Whitman Capital founder Doug Whitman in federal court in Manhattan on Tuesday, Khan said she told Whitman about her sources of inside information at Polycom Inc and Google Inc .

One was Sunil Bhalla, a Polycom executive at the time to whom she referred in her conversations with Whitman as "my guy." The other, called "the IR lady," was Shammara Hussain, then of the investor relations firm Market Street Partners, which had Google as a client. Lawyers for Bhalla and Hussain -- who faced civil charges but were not criminally charged -- could not immediately be reached to comment.

A former Intel Corp and Galleon employee, Khan testified she had two or three meetings with Hussain. "I gave her a phone which I had purchased on my housekeeper's account. I did not want her (Hussain) to be connected to me."

Khan said Whitman, her neighbor in Atherton, California, sent her a basket of flowers with a "thank you" note when she tipped him about a July 2007 Google Inc second-quarter earnings announcement. The information came from Hussain, she said. Khan shared the same information with others she referred to in court as her "buddies on Wall Street."

Hussain agreed to pay $48,000 in January to settle a civil lawsuit brought by the U.S. Securities and Exchange Commission, according to court records.

Khan pleaded guilty to criminal charges in October 2009 but has yet to be sentenced. Dozens of traders, hedge fund managers and a former Goldman Sachs director, Rajat Gupta, have pleaded guilty or been convicted since 2009.

GARDENER'S PHONE

Khan's cooperation with the FBI and U.S. prosecutors helped the government's broad investigations of insider trading, including the May 2011 conviction of onetime billionaire Rajaratnam. He is serving an 11-year prison term.

Khan did not testify at Rajaratnam's trial.

She told the Whitman trial on Tuesday that when the FBI came knocking on her door in November 2007, "I lied about what was my relationship and what information Mr Sunil Bhalla gave me." Bhalla agreed last September to pay $85,000 to settle a civil lawsuit by the SEC, according to court records.

Even after Khan agreed in January 2008 to record phone conversations under the direction of the FBI, she said she wanted to contact her select group of associates secretly.

Khan, dressed in a black pants suit and pink shawl, said: "This time I went to my gardener and used that phone to communicate with some of my Wall Street colleagues."

She spoke in a matter-of-fact tone throughout her testimony, saying she told them the SEC had asked a few questions, but nothing about the FBI investigation.

Khan said Whitman "always pushed me and pushed me to get Polycom information" from Bhalla. Prosecutors played a recording of one phone conversation between Khan and Whitman in January 2009 in which he asks, "You hearing anything on Polycom?"

Whitman is charged with securities fraud and conspiracy, which carry a combined possible maximum prison sentence of 25 years. He has pleaded not guilty to the charges.

Prosecutors accuse Whitman of illegally using inside sources to get advance information on the financial performance of Google Inc, Polycom Inc and Marvell Technology Group Ltd between 2006 and 2009. They said he made $900,000 in profits.

The trial before U.S. District Judge Jed Rakoff started a week ago and is expected to last three weeks.

The case is USA v Doug Whitman in U.S. District Court for the Southern District of New York, No. 12-125.

Scams Target Seymour Families

Local senior care experts are urging Seymour families to be alert for scammers who may be targeting their senior loved ones with a variety of clever cons that could jeopardize not only their life savings but their independence.

?Scam artists are specifically targeting seniors because they are the fastest-growing segment of the population, which has led to increased demands on law enforcement agencies,? said Reed O?Brien, owner of the Home Instead Senior Careoffice serving the Morristown/Sevierville area. ?This scenario has the potential to put more local seniors than ever at risk of losing their life savings, their homes and their trust in others.?

As a result, the nonprofit National Association of Triads and the local Home Instead Senior Care office have launched a public information program to educate families and seniors about how to protect themselves.

The Protect Seniors from Fraud program ? developed with the expert assistance of the Triads ? provides family caregivers with a number of important tools at ProtectSeniorsFromFraud.com. Mars rover landing spotted by orbiting spacecraft

A spectacular photo by a spacecraft orbiting Mars has captured NASA's new rover Curiosity as it plunged toward the Martian surface under a giant parachute.

The amazing image was captured by NASA's Mars Reconnaissance Orbiter, a powerful spacecraft that has circled the Red Planet since 2006. The orbiter snapped photos of the Mars rover Curiosity as the robot dangled from a supersonic parachute six minutes into its "seven minutes of terror" landing late Sunday (Aug. 5 PDT).

The MRO spacecraft used its high-resolution HiRISE camera to capture Curiosity's descent to the floor of its Gale crater landing site. The image was taken just one minute before the Curiosity rover landed on Mars. At the time, the rover and its rocket-powered sky crane backpack were still tucked inside their backshell and were slowing down with the help of the parachute.

"HiRISE has taken over 120 pictures of Gale as part of the landing site selection and characterization process, but I really think this is the coolest one," Sarah Milkovich, HiRISE investigation scientist at NASA's Jet Propulsion Laboratory in Pasadena, Calif. told reporters in a briefing today (Aug. 6). Milkovich unveiled the photo, as well as an inset, today less than a day after the Curiosity's successful landing.? The orbiter was 211 miles (340 kilometers) away from the Curiosity rover when it snapped the photo, and captured amazing details like the lines and hole on the rover's parachute.

"If HiRISE took the image one second before or one second after, we probably would be looking at an empty Martian landscape," Milkovich said in a statement.?

It took months to prepare the MRO spacecraft to photograph the Curiosity rover's landing, Milkovich added. Mission programmers began working on the project in March and only uploaded the computer commands to MRO a few days ago.

MRO was one of two NASA orbiters to watch Curiosity's landing on Sunday. The European Space Agency's Mars Express also helped track the spacecraft while NASA listened to the rover remotely using a Deep Space Network antenna in Canberra, Australia.

The $2.5 billion Mars rover Curiosity is now beginning a two-year mission to search for evidence that Mars could have ever supported microbial life. The rover launched in November 2011 and is the largest rover ever sent to another world.

NASA's MRO spacecraft is the youngest orbiter circling Mars, despite launching in 2005. It has been circling Mars since arriving in orbit in 2006.

"Guess you could consider us the closest thing to paparazzi on Mars," Milkovich said. "We definitely caught NASA's newest celebrity in the act."

Jane investigates the murder of a childhood friend, a member of a popular boy band; Angela finally learns just how close Lydia is to her family.

A man parks his car in an alley and, upon exiting the vehicle, is shot first in both legs, falls to the ground, and is shot again.

Jane and Maura arrive home to see a baby shower in the making. The shower is for Angela?s new friend, Lydia! And she doesnt want to have any grief over it.

Fortunately for Lydia, ?people have to be murdered,? so Jane and Maura leave baby palooza to attend to the crime scene. The victim is Shane Finnegan, a childhood friend of Jane and Frankie and a member of the popular boy band, the Channel Street Boys. Maura finds copper shards embedded in Shane?s face and a small bag of cocaine beside the body; Shane was known for his avid drug use and had a recent stint in rehab.

Jane and Korsak interview Shane?s brothers, also members of the Channel Street Boys; they say that Shane was a no-show for their live webcast, and they suspect drug usage. Maura?s autopsy proves the boys wrong; Shane had been drug-free for the past six months.

Angela begs Jane to show up to Lydia?s special baby shower, and Jane still doesn?t have the heart or cojones to tell Mom the truth about her new friend.

Jane enlists Maura?s help in speaking to Lydia as they go over Shane?s car; no blood was found, and his cell phone was left in the trunk. For reasons unknown, Shane has a military grade cell that self destructs once Frost tries to retrieve the last text message. Frankie brings some good news, though, as he spent the night searching and finding the gun used to kill Shane.

Jane sent a text message from Angela?s phone asking Lydia to meet her at the Dirty Robber. Instead, Lydia finds Maura and Jane impatiently waiting for her arrival. Jane?s all prepared to tell her just how much she and Angela have in common, but Lydia stuns the duo when she says that she?s known all along; she wants to learn from Angela how to be a good mother. Oh, and she doesn?t care to find out the paternity of the baby. What is she smoking?!

Maura, sympathetic over the plight of their delusional friend, convinces Jane to accompany Lydia to her lamaze class.

Maura recovered blood on the grip of the gun used to kill Shane (also known as a wenis, a new fun fact for Maura?s amusement).

Gia Lemond, a well-known pop singer said to have previously dated Shane, is found dead in a motel room. She and Shane attended rehab at the same time, and there?s evidence of drug usage at this crime scene, too.

Jane and Maura show up to Lydia?s shower, mostly to stop Lydia from spilling the beans to Angela, but they?re too late. Angela?s more upset at Jane for keeping this from her. Without any allies in the Rizzoli family, Lydia is dropped off at her home, only to find out that her mother has rented out her room.

TK ?Killer? Womack, manager of both Gia and Shane is brought in for questioning, as he was seen leaving the motel the night Gia was murdered, but the two singers were worth more to him alive, despite their drug problems.

Frost looked into Shane?s financials and found that the group was actually very broke, due to an unfortunate contract agreement. A new clause added to their contract, stipulating that they?d make money over online broadacts and merchandise, would allow their bank account to grow.

Finding Shane?s dad, Ryan, and convincing him to come to the station isn?t the easiest task, especially since he?s now a suspect in his son?s murder. Jane phones him, posing as an insurance company with an uncashed check in his name. When he goes to pick up the check, Jane and Frost are waiting for him.

Shane and Gia were both taking anti-malarial medication. They were planning to go to Haiti together. Shane?s absence would mean the end of the Channel Street Boys and stop the cash flow. The blood on the gun came back as a familial match to Ryan, meaning that one of the brothers shot Shane. Ronan has a hunting license, making it possible for him to have shot Shane from such a long distance.

But the two brothers had an automatic alibi: the live webcast. Frost looks into the program used to stream the webcast and finds that it was shot two weeks ago.

Jane and Frost pay a visit to the two brothers; they?re in the studio, making a ?tribute? song to Shane. Jane confronts the two about their pact to kill Shane; he was leaving the group, and they would lose money. Ronan fired the fatal shot, as the other brother couldn?t bring himself to shoot his brother.

Angela proclaims her desire to move in with a cousin so as not to be seen as a pitiful woman, leaving Jane, Frankie, and Maura to beg Mama Rizzoli to stay. It doesn?t take much to convince her that she is needed right here. Group hug!

Lydia-drama overshadowed the murder of the cutie from the boy band. Though, the not-so-dumb blonde routine was pretty funny. I wonder when she?ll make her next appearance.

The summer finale is almost upon us, and *gasp* Maura?s in danger?again. Methinks these ladies need to leave Boston!

Brazil Olympic football dream still alive after Honduras hiccup

Brazil stayed on course for a first Olympic football gold medal but only after a nervy 3-2 win over a Honduras side reduced to nine men saw them into the semi-finals.

Leandro Damiao equalised for Brazil after Mario Martinez put Honduras ahead. Roger Espinoza then restored the Central Americans' lead.

However, Neymar brought Brazil level again from the penalty spot before Internacional striker Damiao scored his second at Newcastle's St James' Park.

Honduras gave Brazil, five-times world champions but never Olympic gold medallists, a huge scare despite having midfielder Wilmer Cristiano sent off with just 32 minutes gone for a second bookable offence, with Espinoza collecting his second yellow card just before the final whistle.

Brazil's Marcelo admitted: "Honduras made us work really hard. In the end, we showed our quality and we prevailed."

Honduras's Jose Mendoza refused to hold German referee Felix Brych responsible for the end of his side's Olympic dream, saying: "I don't think we can blame the referee for our defeat.

"I think we played a great game and I also think the referee didn't have his best day, but we can't blame him for the result."

Brazil will now face either hosts Great Britain or South Korea, playing later in Saturday's fourth quarter-final, at Manchester United's Old Trafford ground on Tuesday.

Japan stayed on course for an Olympic football double as their men's team joined the women's side in reaching the semi-finals following a 3-0 win over 10-man Egypt on Saturday.

Goals from Kensuke Nagai, captain Maya Yoshida and Yuki Otsu took Japan through against an Egypt side who played more than half the match a man down after defender Saadeldin Saad was sent off in the 41st minute.

Nagai gave Japan a 14th-minute lead, shooting into an empty net after Egypt goalkeeper Ahmed El Shenawi collided with one of his own defenders in trying to deal with a through ball.

Egypt, despite being down to 10 men, came close to an equaliser when Mohamed El Neny's dipping shot was well-saved by Japan keeper Shuichi Gonda.

The unmarked Yoshida's 78th minute header made it 2-0 before another header, from Otsu, completed the scoring.

Afterwards, a delighted Yoshida said: "We have to take the medal, that's all. That's what I say to the people in Japan."

Japan will play Mexico in the semi-finals after the Central Americans survived a dramatic fightback by Senegal to win 4-2.

Senegal came from 2-0 behind at London's Wembley Stadium, in front of a crowd of more than 81,000 to force extra-time.

Mexico will return to Wembley after goalkeeper and captain Jose Corona made several fine saves.

His side side went ahead in the 10th minute when Jorge Enriquez headed in a free-kick and made it 2-0 just after the hour through Javier Aquino.

Moussa Konate, the tournament's top scorer, pulled a goal back in the 69th minute, for his fifth goal the first that Mexico had conceded this Olympics.

In extra-time Giovani dos Santos restored Mexico's lead before the result was put beyond doubt in the 109th minute when Hector Herrera, who will miss the semi-final through suspension, headed into an empty net.

"I'm so happy," said dos Santos. "It's an unbelievable experience for me and the team."

On the surface, it looks like the headline U.S job numbers made Wall Street happy today, as the American economy created 163,000 jobs when economists were expecting 100,000 jobs for the month of July. (Source: Bureau of Labor Statistics, August 3, 2012.)

The good news is that this was the highest showing of job numbers in five months. The bad news is that more people gave up looking for work, as the unemployment rate rose slightly from 8.2% to 8.3%.

The job numbers for the months of May and June were adjusted lower to reveal that there were 6,000 fewer jobs created than first reported, which of course did not help the unemployment rate.

But digging deep within the July job numbers, I see the Bureau of Labor Statistics states that the expected 13,000 seasonal layoffs in the automobile industry did not occur in July, which it believes is a temporary situation. What this means, dear reader, is that the job numbers were skewed higher by 13,000 jobs because the Bureau of Labor Statistics expects these layoffs to occur in the not-too-distant future.

In addition, temporary work, and hiring in the food services and drinking places?the low-paying jobs?accounted for almost 29% of the job numbers gain seen in the month of July.

In light of the fact that many of the job numbers created over the last year were in low-paying sectors of the economy, year-over-year average hourly earnings were flat when compared to the month of June.

Over the last year to July, average hourly earnings are only up 1.7%. When inflation is taken into account that 1.7% gain in wages is completely wiped out.

This is the most startling number in the report we received this morning from the Bureau of Labor Statistics?something the media is not focusing on: the number of people not counted within the labor force increased again to its second-highest reading ever recorded. This means 86.8 million people were not included within the job numbers.

The number of people considered long-term unemployed?jobless for at least 27 weeks?was unchanged, at 5.2 million. As a result of no improvement in these measures within the job numbers, the U6 unemployment rate increased.

U6, as reported by the Bureau of Labor Statistics, is a broader measure of the unemployment rate, because it takes into account discouraged people who are still looking for work, as well as those working part-time who want full-time work. The U6 unemployment rate rose to 15.0% in July from June?s 14.9%.

For the U.S. economy to show any improvement, the U6 unemployment rate within the job numbers must improve, but instead has been deteriorating steadily since February of this year.

The labor participation rate measures all people in the working age population (from ages 16-64) who are actually employed. In April, this rate fell to its lowest level since December 1981: 63.6%. This is a reflection of fewer and fewer people participating in the labor force, because there are no jobs to be had. In May and June, this measure held steady at 63.8%, but in July it fell slightly to 63.7%. It is dangerously close to challenging its record worst levels!

Despite the headline, the job numbers continue to highlight a weak U.S. economy. The unemployment rate has now been above 8.0% for more than three years, which is the longest stretch of the unemployment rate above 8.0% since the Great Depression. It gets worse, dear reader, because U.S. corporate revenue earnings are deteriorating fast, which I?ll be writing about on Monday. If corporate America?s revenue continues to fall, who is going to create the jobs to improve upon the job numbers?

Talk of financial crisis is intensifying in the European Union, as interest rates in Spain and Italy remain at elevated levels and threaten to rise even further. This makes it almost impossible for both countries to go to the market to roll their debt over?unless it?s at impossibly high interest rates, which neither country can afford to pay.

The only reason interest rates have remained somewhat steady recently is that Mario Draghi, President of the European Central Bank (ECB), said the European Union was ready to stand behind Spain and Italy.

This means outright money printing or quantitative easing. But one big objection: Germany continues to insist that Draghi is overstepping his bounds in making such comments and that quantitative easing is not part of the ECB?s mandate and cannot be part of the European Union?s mandate unless all countries agree, including the European Union?s most important member, of course: Germany.

This coming September 12, the German Constitutional Court will rule on the 500-billion-euro European Stability Mechanism (ESM) the European Union is proposing. If Germany does not approve this package, the European Union will be finished, because Spain and Greece will simply run out of money. If Germany does approve the ESM, the European Union is stuck with the same problem: 500 billion euros is not enough to cover the obligations of Greece, Spain, and Italy. A European Union official within Spain is saying?unofficially?that the country needs 300 billion euros in bailout funds! (Source: Reuters, July 29, 2012.)

What this will require is quantitative easing from the ECB. As unemployment in Spain reaches a record high of 24.6%, there are public calls from provincial government officials to leave the European Union. (Source: Telegraph, July 30, 2012.)

The head of Spain?s Freemarket Corporate Intelligence and a prominent economist within Spain, Lorenzo Bernaldo de Quiros, has written an article in Spain?s second-largest newspaper in which he states that Spain will be insolvent later this year. He says it is not an issue of ?if it will happen? but ?when it will happen.?

His argument is that Spain will need to restructure its debt, but if it does so under the European Union, it will face austerity and a continued decline in economic growth like Greece. He feels the best route is for Spain to restructure its debts and go about it alone, because then it can chart its own course and give itself the best chance to come out of this depression it is in.

One thing is for sure; the current path is unsustainable.

As I?ve been writing in these pages all along, dear reader, a bailout of 100 billion euros for Spain is not sufficient. Quantitative easing is the only thing that will keep the European Union together, at least temporarily, in the hopes that economic growth can resume relatively soon. Without quantitative easing, interest rates in both Spain and Italy will continue to rise dramatically, making the rollover of debt almost impossible.

Watch out for that U.S. stock market; if the European Union refuses to embark on a round of quantitative easing, it will cause a crisis that will send shockwaves around the world.

Where the Market Stands; Where it?s Headed:

We?re definitely not off to a good start for the stock market in August. The Dow Jones Industrial Average has been down four of the last four trading sessions.

That bear market rally that started in March of 2009; if the Federal Reserve doesn?t offer some more liquidity soon, it will be over.
